Lobitana v. Jenkins, City of Los Angeles

On July 30, 2010, at the intersection of Edenhurst and Los Feliz Blvd., Los Angeles, California, Plaintiff Asteria Tan Lobitana was walking East on the North side of Los Feliz Blvd. Defendant Jenkins was driving a large yellow stakebed truck owned by the City of Los Angeles, southbound on Edenhurst.

Defendant Jenkins was required to stop at the stop sign on Edenhurst before turning onto Los Feliz, and struck Plaintiff while she was crossing the street.

Ambulance and paramedics responded to the scene, and plaintiff was taken to the Hospital where she was admitted to the Intensive Care Unit.

Plaintiff sustained major fractures of both legs, had skin and muscle tissue torn off her leg, and had multiple surgeries.

The City of Los Angeles disputed liability, and on April 13, 2011, THE LAW OFFICE OF GARY C. ETO filed a lawsuit in the Los Angeles Superior Court, case no. BC 459454, Lobitana, Plaintiff, vs. Jenkins, City of Los Angeles, Defendants. The case settled in late March, 2012, just before trial for $1.8 million dollars.
