Gary C. Eto wins case for Goodyear Tire Tread Separation

The Law Offices of Gary C. Eto is currently representing the plaintiffs in a case against Toyota Motor Corporation and a major tire manufacturer, wherein the plaintiff was rendered a quadriplegic as a result of a tread separation, rollover, roof crush case. The specific vehicle was a 2001 Toyota 4 Runner. The tire was an OE (“Original Equipment,” supplied by Toyota) Grand Trek TG 35 P265/70R16.

On August 28, 2007, while plaintiffs were traveling South on Interstate 99 in Central California, at approximately 65 miles per hour, the tread on the right rear tire separated, causing the vehicle to go out of control and rollover, rendering Adona Dela Pena a quadriplegic. On January 17, 2008, the case, Adona Dela Pena, et al. v Toyota, et al, case no BC383622, was filed in Los Angeles Superior Court, Central District.

The complaint alleges that both the tires and vehicle were defective in design and manufacture. The case is scheduled to go to trial on February 1, 2009.
