Amtrak, Los Angeles Superior Court Case No.: BC079737 Verdict/Judgment date: November 1, 1994 An 84 year old passenger on an Amtrak train was killed when he was thrown from his bed. Former Southern Pacific Railroad Attorney Gary Eto contended that the injuries and resulting death were the result of a defective rail car and improper train handling by Amtrak. Prior to trial, Amtrak offered $100,000 to settle. Plaintiff's demand was $500,000. The case proceeded to trial and the jury awarded the plaintiffs almost $2.5 million dollars.
