GARY ETO FILES ONE OF THE FIRST CASES IN CALIFORNIA AGAINST FIRESTONE AND FORD FOR TIRE DEFECTS AND ROLLOVER DEFECTS ARISING OUT OF THE TIRE RECALL OF AUGUST 8, 2000.

On April 28, 2000, Gary Eto filed a lawsuit against Bridgestone/Firestone and Ford Motor Company alleging both design and manufacturing defects against both Ford and Firestone for fatalities and injuries arising out of the rollover propensity of the Ford Explorer when induced by a tread separation of a defective Firestone tire. The specific vehicle was a 2001 Toyota 4 Runner.

The tire was an OE ("Original Equipment," supplied by Toyota) Dunlop Grand Trek TG 35 P265/70R16. On August 28, 2007, while plaintiffs were traveling South on Interstate 99 in Central California, at approximately 65 miles per hour, when the tread on the right rear tire separated, causing the vehicle to go out of control and rollover, rendering Adona Dela Pena a quadriplegic.

On January 17, 2008, the case, Adona Dela Pena, et al. v Toyota, Goodyear Dunlop, et al, case no BC383622, was filed in Los Angeles Superior Court, Central District. The case is scheduled to go to trial on February 1, 2009.

The case recently settled for a confidential amount.
